Appendix No. 1: Description of Services

1, System administration operations

The basis of system administration operations is 24/7 system administration and engineering availability.

1.1 Server operation description

The operation of servers and the server environment running on them includes configuring and updating operating systems and built-in, OS-level packet-filtering firewalls according to the Client’s needs, as well as continuous monitoring and supervision, and the immediate commencement of troubleshooting in the event of an error, 0–24 hours.

The Client acknowledges that the prices of the system administration operations service may be adjusted, at most once per year, without separate notice, depending on market prices.

1.2 The following system engineering time frames are included in the fee for the basic system administration service:

  • In the case of VPS rental: max. 2 system engineering hours/month

The monthly system engineering hour limits specified in the package apply to the given month and, if unused, cannot be carried over to another period. These hours may be exceeded according to the Client’s needs in a manner agreed with the Client, in which case the overage will be invoiced at the system engineering hourly rate published on the website. The minimum billable engineering time is: 1 hour.

The SystemLock keeps the time records required for settlement in its internal systems. Upon request, SystemLock will send a detailed report of overtime to the service user.

1.3 Details of system administration operations:

  • installation and configuration of the operating system (Linux) after prior consultation and after ordering the service
  • updates
  • continuous monitoring
  • supervision
  • configuration of built-in, OS-level packet-filtering firewalls
  • basic backups (the backup covers the VPS image; backup of client data is possible under a separate agreement)

1.3.1 Details of Linux system administration operations:

We perform Linux system administration operations exclusively on operating systems and software that are in an active lifecycle and supported by the manufacturer. The Service Provider may deviate from this at its sole discretion.

For any software product, support may be provided only after individual consultation, needs assessment, and operational documentation. Support extends to the software’s infrastructure-level support. The Service Provider reserves the right not to undertake support for the requested software.

  • Web server: Apache (optional: Nginx)
  • CGI: PHP (optional: Perl, Python, Ruby)
  • Mail system: Postfix and Dovecot / Courier

  • Database server: MySQL/MariaDB (optional: PostgreSQL, MongoDB)
  • FTP server: PureFTPd
  • Spam and virus filtering: Amavis and SpamAssassin

Available control panel:

  • cPanel

Server configuration and updates (custom infrastructure design based on an individual contract).

Maintenance and updating of the server’s software components. Upon completion of software maintenance and update operations, the Service Provider may perform scheduled or unscheduled reboots as necessary in order to preserve operability and for testing purposes. Scheduled reboots, where possible, take place on business days between 06:00 and 08:00; however, the Service Provider may deviate from this time window based on its knowledge of the specific properties of the system running on the server.

If the Client does not provide documentation or does not notify the Service Provider in writing in advance about prerequisites and dependencies, then any data loss or service outage resulting from framework updates shall be borne by the Client. The costs of restoring the service shall be borne by the user.

We generally perform regular update maintenance on Tuesdays between 07:00 and 09:00. We notify the client about system maintenance and expansion. The maintenance time determines the start of maintenance. The end time of maintenance may depend on the nature of the maintenance. The Service Provider performs the necessary maintenance and updates in the shortest possible time and then restores live production operation. In extraordinary cases, the Service Provider may perform maintenance on a schedule different from the one specified.

If the client has system administrator privileges, then the Service Provider assumes no responsibility for the operated server. The client assumes legal responsibility in all cases for improperly licensed products. The Service Provider reserves the right to restrict or delete access to improperly licensed software without notice. In the event of a server update, if the Client has not purchased a service that supports data backup, then backing up the data is the Client’s responsibility. SystemLock shall bear no liability for any damage arising from failure to perform backups.

2, Virtual server rental (VPS)

The essence of the VPS Service is that the client receives limited virtual server access on a shared server, according to the relevant technology, based on the VPS packages displayed on the Service Provider’s website. Although the VPS operates on a shared server, it functions as an independent unit and provides the same performance, memory, storage, and functionality as a physically separate server. Subject to compliance with this GTC, the applicable laws, and the acceptable use policy (AUP) related to the mediated infrastructure service, any online service may run on it. The ordered resources are provided in a shared environment due to the nature of the service.

To provide the VPS service, the Service Provider may use infrastructure operated by a third party. Section 10.6 of these GTC shall govern the mediated service and restrictions related to the third party.

The CPU utilization of the server serving the VPS service, as a result of the applications used by the client, may not persistently and repeatedly exceed 90% of the Server’s total CPU time. Above this value, the Service Provider is entitled to restrict the Service (except in the case of Dedicated CPU).

The Service Provider provides data backup for the VPS only upon separate request for a quotation and for a fee. Backing up the VPS files and content is the client’s responsibility. The Service Provider assumes no liability whatsoever for failure to perform backups and therefore also draws the client’s attention on the website and in these GTC to preparing appropriate individual backups.

The Service Provider assumes no liability for any damages that may arise from reaching, exceeding, and the consequences of exceeding VPS limits.

Maintaining and servicing the physical server under the VPS is the Service Provider’s responsibility, while software provisioning, software operation, and updating of the server are within the Client’s scope, just as if the Client were renting or purchasing its own server. The VPS runs its own operating system, and we provide clients with superuser access. This also makes server setup and configuration easier.

VPS downgrade is not supported; this function can only be implemented by placing a new order and migrating, which, if the Client does not have an active operations service, must be handled within the Client’s own scope. The VPS affected by the downgrade may only be cancelled once the migration has been completed.

3, Hosting service

Our service ensures the continuous operation and availability of our Clients’ websites and email addresses under a freely selectable domain name.

If you do not yet have a domain name, choose one! Here you can check whether the desired name is available or has already been registered by someone else. We will register the chosen domain name.

After registering the selected domain name, the completed pages can be copied to our server via FTP access.

Our clients can create their email addresses belonging to the domain name via a web administration interface or with the help of our colleagues.

Emails can be read using an email client (POP3, IMAP) and via a web interface.

4, Domain registration

In providing the service, SystemLock participates as a data controller with regard to partner data.

The Client may request domain registration through the Service Provider. By submitting the request, the Client declares that it accepts the regulations prescribed by the registry organization of the selected TLD (extension). (E.g.: in the case of .hu: ISZT (www.domain.hu), in the case of .org: ICANN (www.icann.org), etc.) The Client declares that it accepts the decisions of the Service Provider and the Registry belonging to the given TLD in matters related to the domain request, delegation, and maintenance. (e.g., in the case of providing false data, the domain will be placed on the deletion list and locked)

The Client is obliged to provide a signed application form or to submit the application electronically in a lawful manner in accordance with the rules of domain.hu from the syslock.hu website. The Service Provider shall do everything expected of it to ensure that the domain is registered as soon as possible. The Client assumes criminal liability for the content under the domain and for the data provided.

If the Client has already fulfilled its payment obligation and its obligation to submit documentation or electronic registration, it may request the Service Provider to register the domain if the registration process has not yet been initiated.

The Service Provider assumes no liability for failure to register the domain initiated by it or for the expiration of the domain name if it is the result of the Client’s omission. If the request has been submitted to ISZT within 30 days from submission of the application, the Client shall not be entitled to a refund.

If the Client transfers the domain name to another registrar, it declares that it permanently waives any and all financial and other claims against the Service Provider.

Electronic .hu domain registration is valid exclusively for the delegation of a new, non-existent domain, and not for data modification and transfer registration or any other domain service.

4.1 Client declaration required for requesting the delegation of an Internet domain under .hu public domains

  • I know and accept the Domain Registration Policy and I comply with the provisions of the Domain Registration Policy in force at all times;
  • I accept the decision of the Registry and the Registrar in matters related to the domain request, delegation, and maintenance;
  • I acknowledge that in the event of a dispute related to the compliance of requests with the Domain Registration Policy, the Registrar and the Registry submit themselves to the decision of the Advisory Board;
  • in disputed matters related to the chosen domain name, I submit myself to the decision of the Alternative Dispute Resolution Forum, and I acknowledge that in any legal dispute initiated against me in connection with the chosen domain name, I may enforce a legal remedy claim exclusively against the Applicant, and furthermore, that neither the Registrar nor the Registry is responsible for the enforcement of the decision made during the alternative dispute resolution procedure;
  • I warrant that I have completed the application form truthfully, and I acknowledge that if the data provided is not true, or if I do not report changes to the data, it will result in the revocation of the domain name;
  • I have read the application form in full and signed it in agreement

5, Protection of intellectual property

The configurations of servers, routers, firewalls, etc. already operated and set up by the service provider are the service provider’s own intellectual property and also constitute the service provider’s business secrets; therefore, they will not be handed over to the client even if the client cancels the operations service.
